STOLEN CELS chyoufeng

From what I can tell, the situation is thus:

(1) There are divorce proceedings currently open between Carly and her estranged husband.

(2) He has possession of her collection and is selling it off.

(3) He is using his present girlfriend's e-mail (hence the user name) and is still using the joint Paypal account he shares with Carly (don't ask me why anyone would do something like this, I don't know).

(4) He takes no responsibility for her previous sales/swindles.

(5) She is taking very little responsibility paying people back, but HAS reopened lines of communication. Some she promises VERY long payment plans, others she pleads poverty to.

I emailed Carly again just to see if I would get a response. Well, I got one really quick. It states that as far as she is concerned her husband sent out the cels & that she will try to get in contact with him to see what is going on. She also stated that she cannot pay be back as she cannot afford to.

I really wish I could get the cels because some were wishlist but I know that’s not going to happen. Would have be been somewhat happy with getting my money back abut that looks like that is not going to happen either.

This is sad because this situation make the community look bad. Plus this experience has really put me off.

My concern now is that he doesn't legally have the right to sell her cels. I just hope I don't mind myself contacted by British solicitors over who legally had the right to sell those pieces.

Not to mention, that I may need to contact my own lawyer about this transaction, seeing as how I've just purchased cels which were sold (and not delivered) to another collector about 2 years ago. Will I find myself in possession of "stolen" goods, or is Carly considered a swindler and this guy completely at liberty to sell the items in question? AUGH!!!!

This whole situation has turned into a circus. I'll be very happy when its over.

Not to speak ill of anyone, but the entire situation of hers sounds like BS at the worst, and very poor judgment at the best. I badly feel for those involved. It only sours the cel collecting process.

Carly's ex-husband would like for me to post this, since he does not have access to the forum:
I will post the cels of the other girls, not sure of their names tomorrow too. My girlfriend is meeting Carly tomorrow to get the addresses of the two that bought from Carly a couple of years ago. I don't have access to your forum so can you pass this on for me. As for the other cels (the yue ones) I will be posting them. I promise that so if you can pass that on too.

Thank you Brenda, apologies again for the huge mess here.

Divorce is a horrid thing. I don't want to bad mouth Carly because I did love her, when she was ill she changed and has never been the same. She withdrew from everything and her personality flipped so please don't blame her...if we can sort it out, can this all be forgotten?

I totally agree, it all sounds like a scam to me. I strongly advise those who just bought from her or "her ex" to file a paypal claim and get your money back before the 30 days is up. I seriously don't think any cels will be sent to anyone...As for the whole divorce proceedings, I don't believe it one bit. When in the process of divorcing both parties' joint monetary assets should be frozen, so technically her ex couldn't possibly have access to their supposed paypal joint accounts. They've been doing this since 08' as one collector pointed out..what makes you think they won't do it again?

Update: I recieved an email from Carly stating that she would be meeting up with her ex's girfriend to get my contact info so that they can send out the cels that I purchased in 2008 & never recieved.

She appoligized that I got caught up in her divorce mess & hope that everything will work out.

I emailed her back stating that I can understand how thing can happen but that she should have at least kept in contact with the sellers that were having issues.

Well, it sounds as if things are getting squared away.

Although I can hardly wait for this to be over, at least I'm happy that my wacko transaction is causing them to bring closure to other collectors. I hope that everyone involved either gets their money back, or their cels.

The question about this would be if the property was obtained during the marriage or not. If it was than it would be considered joint property and they both have a right to sell it. Even if it was not it could be hard to prove unless she had some sort of documentation to the fact. Now I am not a lawyer but I believe the items would not be consider stolen, if I read this correctly, they are still legally married, so he should still have the right to sell it. It is kind of like when a couple who are estranged have a joint bank account and one of them take almost all the money out of it. The other person can do nothing about it.

Thought I'd chime in with my update :)

I should be receiving all my missing cels (less one + a couple of freebies) shortly (thanks to Rei :bow2: ) -- I will let everyone know when they arrive

I don't post often so I apologize in advance if this is posted in the wrong place. Just thought I should chip in that the Touya cel I bought from this seller has arrived promptly today and communication has been professional.
