I am just going to link the forum post on ebay. Makes it easier. It sounds like merchandise(toys, stationary, clothes, and etc) that has been manufactured for children under the age of 12 has to be tested for led before you can sell it/donate it. This is effected February 10th.... it also has to be tested by some third party BS. I dunno. I am still reading up on it and worried about old Sailor Moon merchandise I never sold. @_@ Better sell it before February. HAHA

Sounds like you gotta pay to get your crap tested... or you can not sell it at all because they assume it is hazardous. fun stuff.

Good grief! I've sold some Star Wars figures, most of which were mint in their packaging, an noticed a small warning as I submitted my auctions. It was basically stating that some toys could be dangerous, yadda, yadda (I didn't pay much attention). I still have some stuff to dump so I'll make sure to get them auctioned before the date.

Crap that didn't cross my mind! Does this mean there will have to be a black market for unopened vintage/collectible toys!! So, if you put a disclaimer on your item that says "Not designated for individuals younger than 13 years of age", will that help?
I ask because *anything* can be considered for children younger than 12 nowadays. Some products, like baby toys, obviously, are intended for little tykes. But what about computers? Cameras? Anime trading cards? Do these now have to feature warnings too?
I ask because most collectibles don't appeal to children younger than 12 years old. Children want to play with an item - they're generally not going to put the item on the shelf and look at it.
The law is about as clear as mud, and E-bay will only be hindering its already crumpling business by prohibiting all sellers from selling 'toys', even if those toys are normally purchased by people older than 12 years of age.

I don't know that anyone here is going to have to worry about it for now. According to the pdf, the certificate requirement only applies to items manufactured on or after November 12, 2008, so old collectibles shouldn't be affected. The only problem I forsee is if you're importing new toys or something from Japan and they haven't been certified by the manufacturer and customs picks up on them.
Edit: I've actually been emailing with Jennifer Sharp at nsf.org, who is in the pdf at the end. She says that vintage collectibles shouldn't be affected, but any merchandise marketed at children up to the age of 12 will have to be certified by the manufacturer before it can be imported. It doesn't sound good for anyone who wants to import anime toys, stationary, etc. to the US in the future unless the Japanese companies are going to go to the trouble of certifying that their merchandise meets the US standards.

I believe it would depend on how the product is marketed. A collectible item not intended for children would not be required to bear a certificate, however if the product is sold as a toy intended for children, the manufacturer would be required to certify the product before it could be imported.

I believe most Japanese toy products already meet the new US standards. I recall reading somewhere that the US is the 'dumping ground' for toys that are unable to sell in the EU and Japan due to higher toy standards. So, toys imported from these countries may not be affected due to their already high standards.

it sounds like though, all toys sold in the US will have to have some sort of seal or something showing that they have been approved to be sold in the US because they have passed testing. Customs will just block all toys without the Certification.
Customs will either ship the toys back or throw them away.

They'll check your containers and charge you hundreds and thousands of dollars to slice open and break your items... lol...
